The following terms and conditions apply to all orders, unless otherwise agreed.
The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully before placing your order
General
The Cargo Bike Company is referred to as “I” “we” or “us” in these terms and conditions
Buyer/Purchaser/You means any person, sole trader, partnership, business, body corporate or other entity detailed in the appropriate section of the sales invoice/order form
We reserve the right to amend technical or clerical errors in any order without notice. In addition, the buyer shall ensure that all details contained within the order are correct and no liability for any error or inaccuracy shall lie with us.
Prices for custom bike builds
Following quotation the price will be fixed unless the customer changes the specification required. Upon acceptance of a quotation the price will not vary if the specification is not changed by the customer.
Timescales
Following receipt of a deposit we shall confirm the manufacturing slot of your cargo bike and the likely build duration and delivery date. Manufacturing slots, build durations, and delivery dates are estimates only. The Company shall not be liable for any costs, losses, or damages incurred by The Buyer due to a delay in delivery.
Limitations Upon Liability
Advice given by us during the order process is based entirely upon information given by the purchaser, such advice is an opinion only and we shall not accept liability for any inaccuracies.
The Buyer acknowledges that The Company’s liability is strictly limited to the goods being fit for the general purpose of a cargo/ice cream bike and expressly excludes any specific, alternative, or modified use determined by The Buyer.
No liability for failure can be accepted by us for such alternative use, amendment or modification.
Cancellation of order and refund
If you cancel the order before we dispatch the goods, we will refund you the full amount paid minus the initial deposit.
If you cancel the order after we dispatch the goods, we will refund you the full amount paid minus the initial deposit and postage. You will have to pay for the return of the item to us.
The initial deposit (20% of the total price) is non-refundable once The Company has commenced the design or material sourcing phase.
Goods that are manufactured to the Buyer’s unique specification, including but not limited to custom sizing, branding, non-standard componentry, or unique colour specifications, are considered non-cancellable and non-refundable once manufacturing has commenced, unless the product is found to be faulty.
Payment terms
Standard payment terms are 20% deposit on order. Following completion of the order the 80% balance is due prior to delivery.
After 30 days of non payment, interest will be added to an invoice at a standard rate of Bank of England base rate plus 8%.
International Delivery
All products to international (non United Kingdom countries) are sent DAP (Delivered at Place – Incoterms 2020). All local duties and taxes are to be paid by the customer.
Liability
The Company does not exclude or limit its liability for: (i) death or personal injury caused by its negligence; or (ii) breach of the terms implied by Section 12 of the Sale of Goods Act 1979 (title and quiet possession). The Company’s maximum aggregate liability to The Buyer for any claim arising out of this contract shall be strictly limited to the total price paid for the goods.”
Warranty
The Cargo Bike Company warrants the frame of each new Cargo Bike Company branded bicycle to be free from defects in material and workmanship for a period of one (1) year from the date of purchase, excluding corrosion caused by scratch penetration of powder coating. All other original components, electric assist packages and all repair parts, replacement parts and accessories are warranted to be free from defects in material or workmanship for a period of six (6) months from the original date of purchase.
In the event of a warranty claim the owner can return the cycle back to us at the owners expense and parts will be replaced free of charge.
Limited Remedy
Unless otherwise provided, the sole remedy under the above warranty or any implied warranty is limited to the replacement of defective parts with those of equal or greater value at the sole discretion of The Cargo Bike Company. You will be responsible for labor costs associated with warranty replacements. IN NO EVENT SHALL THE CARGO BIKE COMPANY BE RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, WARRANTY, NEGLIGENCE, OR PRODUCT LIABILITY, OR ANY OTHER THEORY, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY DAMAGES, PROPERTY DAMAGE, OR ECONOMIC LOSSES THAT ARE BEYOND THE VALUE OF THE PRODUCT.
